Ferrari Wins Logo Lawsuit
Ferrari has won its lawsuit against the German sales chain Kik, for a case of counterfeiting in Germany.
Kik was selling some Formula 1 model toys in its shops. The toys were painted red and featured a logo that could easily be confused with the Scuderia Ferrari logo.
The German court ruled that, because in Germany the Ferrari brand has legal protection being well known and famous, producing a model of a race car featuring a logo with an animal in a dynamic position on a yellow shield constitutes on all counts a violation of the Ferrari brand and is counterfeit as it is deceives the consumer at the point of purchase.
The case was heard at the Dusseldorf Tribunal, where Ferrari was represented by the Legal firm NCTM, with help from the German firm Rospatt Osten Pross.
